Terms of Service

These terms govern the use of the Hearium app and the paid Hearium Pro subscription.

2. Service

Hearium helps you record conversations you start yourself, transcribe them on-device, and analyze them for rhetorical patterns, evasion, vagueness, missing information, and contradictions. Hearium makes no claim about truth or lies and is not a legal, medical, or evidentiary tool. Results are indications, not findings.

3. Permitted use & consent for recordings

Recordings are started exclusively and explicitly by you. You alone are responsible for being permitted to record. In Germany, recording the non-publicly spoken word without the consent of everyone involved is a criminal offense under § 201 StGB; comparable rules apply in other countries. Before every recording you confirm in the app that everyone involved consents. Covert recording is prohibited.

4. Hearium Pro subscription

Hearium Pro is an auto-renewing subscription handled and billed through your Apple ID (Apple App Store / StoreKit). It is offered as a monthly, quarterly, or annual subscription; the applicable price is shown in the app before purchase.

• Payment is charged to your Apple ID account at confirmation of purchase.
• The subscription renews automatically at the stated price unless canceled at least 24 hours before the end of the current period.
• You can manage and cancel the subscription at any time in the subscription settings of your Apple ID account. Cancellation takes effect at the end of the current period.
• A free trial (if offered) converts automatically into a paid subscription unless canceled; any unused portion of a trial is forfeited upon purchase.

5. Right of withdrawal and refunds

The purchase of Hearium Pro is concluded through the Apple App Store; your contractual partner for the purchase is Apple (in the EU: Apple Distribution International Ltd., Ireland). The Apple Media Services terms, including the withdrawal instructions they contain, therefore apply to the purchase. You exercise your statutory right of withdrawal as a consumer against Apple; refund requests go to reportaproblem.apple.com or directly to Apple Support.

6. Fair use

To protect against abusive use and for cost reasons, fair usage limits apply (e.g. daily analysis quotas). Details are shown in the app.

7. Liability

Hearium is provided with the greatest care but does not replace your own judgment. Analysis results are machine-generated indications; decisions you make based on them are your own responsibility.

We are liable without limitation for intent and gross negligence and for damages arising from injury to life, body, or health. In cases of slight negligence we are liable only for the breach of essential contractual obligations (obligations whose fulfillment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely), limited to the foreseeable damage typical for this type of contract. Liability under the German Product Liability Act remains unaffected.

8. Changes

These terms may be updated; the current version is available at hearium.app/en/terms. The German version at hearium.app/agb prevails in case of discrepancies.
